Freezing injunction

freezing injunction: previously called a mareva injunction; an interim remedy which the court may grant in business litigation prohibiting a defendant from removing its assets from England and Wales, or from disposing of its assets or diminishing them below a certain value; an interim freezing injunction will be of use for claimants who are concerned that, before their claim against the defendant is fully tried, the defendant will dispose of assets in order to frustrate the claim. The applicant to a freezing order application will need to file evidence proving that they have a good arguable case and that the defendant holds assets and is likely to move them out of the jurisdiction or dispose of them.
