Negligent misstatement

negligent misstatement: a type of negligence action that can be brought by someone who has relied upon advice or a statement that is negligent; an underlying contractual relationship does not need to exist between the claimant and the defendant who dispensed the negligent advice or statement; a successful claim for negligent misstatement requires a claimant to prove that he was in a relationship of proximity with the defendant, has suffered harm as a result of the defendant’s statement that was reasonably forseeable and that it is fair, just and reasonable to impose liability.
