Summary judgment

summary judgment: disposal of a claim, or a defendant’s defence to a claim, at a procedural hearing (rather than a full trial), on the basis that the claim or defence has no real prospect of success and there is no other compelling reason to dispose of it at trial; parties to civil litigation can apply for summary judgment under Part 24 of the Civil Procedure Rules and applications can be based on a point of law, evidence, or a combination of law and evidence.
